Phase II Environmental Site Assessments (ESA)

Innovative’s team of scientist have completed Phase II ESAs at well over 400 project locations in Michigan. Phase II ESA projects are tailored to the objectives of each customer, while keeping both their timeline and budget constantly in focus.

Senior Project Scientists with over 10 years experience design each Phase II ESA project, taking into account the suspected geology and hydrogeology as well as identifying the potential receptors in the study area.

A large number of Innovative’s Phase II ESA projects are done in conjunction with the purchase of a property. Nearly 75% of all Phase II ESA projects identify the presence of “facility” level contamination, which leads to the Baseline Environmental Assessment (BEA) option under Part 201 of Act 451 of 1994, as amended. Innovative specializes in providing our customers with customized BEA reports and packages.

Phase II ESA projects range from $3,500.00 to $15,000.00 and up depending on the circumstances. BEA reports and packages usually range in price from $3,500.00 to $5,000.00 and up.

Important Notes – If you are intending to purchase a property, it is important to retain Innovative a minimum of 30 days before closing (the purchase date) in order to allow Innovative sufficient time to complete the Phase I ESA and the Phase II/BEA Report within 45 days after the date of closing. If an ample amount of time is not provided prior to closing, the post closing 45 day timeframe may be difficult to meet and your opportunity to obtain an exemption from liability may be lost.

In Michigan, the MDEQ has provided two options for submittal of your BEA Package. The simpler and less expensive option is to have your BEA Package submitted by the Disclosure Method. This method requires the signing of a simple two page disclosure form and submittal of the BEA Package prior to or within 8 months of the date of your purchase. The second option, the Request for Determination option, which many banks mandate, your BEA Package must include the $750.00 filing fee, the petition form, an affidavit (signed by the petitioner or the purchaser) notarized and a second notarized affidavit signed by one of Innovative’s Senior Project Scientists. By paying the $750.00 fee, the MDEQ is required to review and forward a response within 15 business days of the submittal of the BEA Package.
